Terms Of Service – Melodong Studio

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the services developed under the brand “Melodong” operated by Melodong HK Limited. Melodong is a developer and publisher of games and mobile game applications that are made available through app stores, including the Apple Store and the Google Play Store.

As a precondition for your usage of these Services, you must agree to these Terms of Service. By using or otherwise accessing the Services, you agree to the Agreement. If you do not agree to the agreement, you may not use or otherwise access the Services.

1. About

By downloading one of our Games, you accept this Agreement and our Privacy Policy. Each time you download one of our Games to your device a new Agreement is concluded and its terms apply to your use of this Game.

You represent that you are 16 years or older. If you are younger than 18 years, you can only download our Games if your parent(s) or legal guardian have/has reviewed this Agreement and allowed you to do so.

2. End-User License Agreement - EULA

2.1 License: Melodong grants you a non-transferable, non-exclusive, license to use for your personal use and copy for the purpose of downloading, installing and executing on a mobile device that you own or control.

2.2 Restrictions: You shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any Game. You shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Games.

3. User Content

“User Content” means any and all content that a user uploads, distributes, or otherwise provides via any Game. You are solely responsible for your User Content.

4. Term and Termination

This User Agreement runs for an indefinite term. Either Party may terminate this Agreement at any time by giving 14-days notice. You may also terminate with immediate effect by deleting the Game from your device.

5. Indemnity

You agree to defend, indemnify and hold harmless Melodong from and against any claims, suits, losses, damages, liabilities, costs, and expenses resulting from or relating to your use of any Game.

6. Third Parties

You acknowledge that the availability of the Game is dependent on the third party from which you received Game, e.g., the Apple iPhone or Android stores (“Application Store”).

7. Disclaimers

GAMES ARE PROVIDED “AS-IS” AND AS AVAILABLE. MELODONG EXPRESSLY DISCLAIMS ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

8. Limitation on Liability

IN NO EVENT SHALL MELODONG BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES.

9. Fees

Melodong may license to you certain virtual goods to be used within the Service which you may purchase with real cash or earn via gameplay (“Virtual Items”). All purchases are final and non-refundable.

10. Miscellaneous

This Agreement is subject to occasional revision. Continued use of our Games following notice of such changes shall indicate your acknowledgement of such changes.
